Contract Disputes

Our experienced and highly effective Commercial Litigation group represents clients in a wide range of contractual disputes, including:

  • Breach of Contract
  • Failure to Perform
  • Anticipatory Breach
  • Duress/Undue Influence
  • Rectification
  • Specific Performance
  • Waiver and Force Majeure/Frustration
  • Shareholder Agreements
  • Agreements of Purchase and Sale
  • Commercial Leases
  • Contracts for Goods and Services
  • Construction contracts
  • and more….

Contract disputes arise when a party to a contract fails to complete its side of the bargain in accordance with the terms of the contract.

We are often engaged when contractual disputes are anticipated or developing, with the aim of providing clients with leverage to address the dispute before it requires the Court’s intervention. At the same time, we assist clients in positioning for and advancing formal litigation that might follow. When the time comes, we are passionate advocates for clients at all Court levels in Canada, and before administrative tribunals.

Often, contractual disputes have broader implications for a business beyond whether the specific issue is resolved favourably or not. These disputes can impact a variety of relationships and our experienced and knowledgeable team understands that when we litigate, it is about winning the day, but also about helping our clients achieve their broader business objectives.
